I've the same problem using the TOP statement with ASA. Your suggested workaround will not work since I do not know that there may be less records than my TOP statement defines.
How did the BDE handle this problem? We never experienced this problem with BDE.
When the error occurs - does AnyDAC already hold the first records? If yes what about "ignoring" the error message and returning the records we got?
